Victory In VA Retiree Benefits Class Action

On March 16, 2022, the U.S. District Court for the Western District of Pennsylvania ordered the Office of Personnel Management to recalculate the retirement benefits of a class of retired VA nurses that Stember Cohn & Davidson Welling has represented since 2010. During the 12+year course of this case, Stember Cohn Davidson-Welling LLC defeated three separate attempts to dismiss the case. When OPM still refused to act, the firm obtained an injunction ordering OPM to pay increased retirement benefits to the Class, as it had promised to do in thousands of notices sent to the Class. As a result of the court’s ruling, OPM has increased monthly benefits for eligible class members and commenced payment of past benefits owed.
